This is something. A tip of the hat to Lynn, who emailed a link to Grist.org’s coverage — written by journalist David Gumpert of TheCompletePatient.com fame. This is more than timely — for years, raw dairy farmers in certain states have been shamefully set upon for producing raw milk for sale to the public.

As ex-Californians who -gasp!- consume raw milk (which is legal to sell in California but under fire there and elsewhere), we’ve covered some of these issues (various articles here), we’re pleased to see a direct line of attack on this foolish but damaging behavior. As the article states:

The suit is notable for seeking to shift the focus of the interstate raw milk prohibition to consumers from farmers, where the FDA has focused its efforts, most notably in prosecuting the largest raw dairy in the country, Organic Pastures Dairy Co. in California, for selling milk outside its home state. The agency was behind a criminal case against the dairy, which ended with a guilty plea last year and an agreement by the dairy to confine its sales to California, and a civil case, which is still pending. The agency has also been active behind the scenes in urging crackdowns on raw milk in Michigan, Ohio, Wisconsin, Pennsylvania, and New York, among other states.

And, more to the point:

That the FDA is singling out raw milk for special harsh treatment. According to the suit, “There is nothing in the PHSA [Public Health Service Act] that authorizes the FDA to find that a product that is legal to sell in more than half the States and where it is legal to consume in all 50 States should be banned as a ‘communicable disease’ or ‘illness’ particularly when there are other foods in the United States that cause more cases of foodborne illness.”

Lastly, the Farm-to-Consumer Legal Defense Fund’s website lists various issues and petitions; it’s a get-involved kind of organization protecting consumer rights, food safety and the like.

It’s a good thing; otherwise, we have a too-slow government that sees no wrong in processed "food" and pills and prescriptions as a way of life … but vilifies raw milk, even though our ancestors lived on it throughout their lives.

Tsk, tsk.

    We have been consuming raw milk over 30 years. We currently have two Jersey’s and a cow share program that requires the herd share owner to milk the cows himself and take home all the milk he gets from the cows. We also have a farm share.
    I would like to see mro efarms dong this so that consumers will be made aware of the hard work involved..

    Bravo!! About time the tables got turned on this gang of goons.

    Here in Canada, raw milk producers, like myself, have the same problem with the health authorities. If they say we’re guilty >> WE’RE GUILTY…NO IFS, ANDS, OR BUTS ABOUT IT…PERIOD << It's an arbitrary decision that does not involve a court process. The health authorities don't stop there though. Harrassment, crippling fines, liens on your property, jail time and it ends only when they're satisfied.
